What this site is, what it is not, and the basis on which you use it.
1What this site is
Standard publishes general information about criminal law and court procedure in New South Wales, written by practising criminal lawyers, for people who are going through the criminal justice system and for people who want to understand it. It is a legal education platform operated by Standard Criminal Law. It is not a law practice and it does not act for anyone.
2What this site is not
It is not legal advice. Legal advice is an opinion about your situation, given by a lawyer who knows your facts and has agreed to act for you. Nothing on this site is that. The guides and the courses describe how the law and the courts generally work; they cannot know your facts, your record, the wording of your charge, or the practice of the particular court and Judge you will appear before.
Reading it does not make you a client. No solicitor-client relationship is created by reading any page, marking a lesson complete, downloading a document, saving your details, or sending a message through the consultation form. A solicitor-client relationship with JBP Law arises only when JBP Law confirms in writing that it has accepted your instructions.
It is not a substitute for a lawyer where one is needed. The courses and the guides say, at specific points, that a matter has moved beyond what general information can safely cover. Those points are there because self-representation past them carries real risk. If your situation matches one of them, get advice.
3Accuracy and currency
The law changes. Legislation is amended, courts decide new cases, penalties and thresholds move. Each page carries the date to which it is current. We take care to keep the content accurate, but we do not warrant that any page is correct, complete or current on the day you read it, and you should confirm anything you intend to rely on against the legislation, the court, or a lawyer.
4Your responsibility
Decisions about your matter, including whether and how to plead, what to say in court, what to file, and whether to appeal, are yours. If you make them using information from this site, you make them on the basis that the information is general and that you have judged its application to your own situation, or obtained advice on it.
5Liability
To the extent the law allows, Standard Criminal Law and the lawyers who write for it exclude liability for any loss arising from reliance on the content of this site. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where liability cannot be excluded, it is limited, at our option, to resupplying the information or paying the cost of having it resupplied.
6Intellectual property and permitted use
- All content on this site, including courses, lessons, guides, tools, text, structure and design, is owned by Standard Criminal Law and is protected by the Copyright Act 1968 (Cth) and other intellectual property laws.
- You may access and read the content for your own personal, non-commercial use in connection with understanding your own matter or your own study. That includes printing or saving a page, or a PDF summary, for that purpose.
- You must not copy, reproduce, republish, scrape, extract, distribute, sell, license or create derivative works from any part of the content, whether manually or by automated means, without our prior written permission.
- Automated access, including scraping, crawling for the purpose of extraction and bulk downloading, is prohibited other than by search engines indexing the site in the ordinary way.
- Any permitted use must retain all copyright notices. We may withdraw access from any person who breaches these terms.
- Nothing in these terms grants any licence to use our name, wordmark or branding.
7Consultations
A consultation requested through this site is provided by JBP Law on JBP Law's own terms, which will be given to you before the consultation. Any fee for a review or for representation is quoted at that consultation.
8Your details and progress
If you save your details on a course, they are handled as described in our privacy policy. Course progress is stored in your own browser unless you choose to send yourself a link or save your details with us.
9Governing law
These terms are governed by the law of New South Wales, Australia, and any dispute about them is to be dealt with by the courts of New South Wales.
